The Lord of the Work
There is nothing more that a praise dancer wishes for, but to
have opportunities to dance God’s Word anywhere.
Ministering outside of our churches can be very challenging at
times, but so rewarding afterwards.

To start off, your dance group must have been called by the
Lord to do such a job, because God is a God of order and He
will ordain your group to minister wherever He wants.

There are dance ministries that were created and anointed to
dance in the sanctuary only, and that is a wonderful gift!
Others are blessed with the job of ministering outside, and
some will do both; but the end result is the same: we are all
fulfilling the Great Commission, and there is no need to wish
for a different kind of ministry, or to get mad at the Pastor.

In the Amplified Bible, 2 Corinthians 3:6 reads: [It is He] Who has qualified us
[making us to be fit and worthy and sufficient] as ministers and dispensers of a
new covenant [of salvation through Christ], not [ministers] of the letter (of legally
written code) but of the Spirit; for the code [of the Law] kills, but the [Holy] Spirit
makes alive. The last two parts of this series (Company Keepers February and
March 2007) have dealt with the letter and intent of the law of copyright. This part
offers a glimpse of the spirit behind the law and provides hope for many who have
been greatly convicted by the last two installments.

The law of God convicts us and causes us to see how utterly lost we would be
without the grace and mercies of God. The Holy Spirit makes us alive, enables us
to thrive and helps us with our weaknesses. Likewise, these exceptions to the
copyright law provide grace to all of us who desire to share with others the
wonderful things we have learned or experienced through the copyright work of
others. Three of the areas of grace examined in this article are: 1) Fair Use, 2)
Works in the Public Domain, and 3) The Worship Service Exemption. Additionally,
this article gives you references so you can begin your own deeper study of how
all of this impacts you and your ministries.

Father God, on behalf of every reader I pray that You: “Deal bountifully with Your

1. EXCEPTIONS – Every way of a man is right in his own eyes, But the LORD weighs the hearts. To do righteousness and justice is
more acceptable to the Lord than sacrifice. Proverbs 21:2-3 (NKJV)

A. Fair Use

Fair Use is a doctrine (that has been made law) that says: although copyrighted material belongs to the owner of the copyright, there are
limited instances when it is fair for the public to use the material without having to formally request permission. Section 107 of the
Copyright Law of the United States reads as follows1:

§ 107. Limitations on exclusive rights: Fair use2

Notwithstanding the provisions of sections 106 and 106A, the fair use of a copyrighted work, including such use by reproduction in copies
or phonorecords or by any other means specified by that section, for purposes such as criticism, comment, news reporting, teaching
(including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright. In determining whether the use
made of a work in any particular case is a fair use the factors to be considered shall include —

(1) the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes;

(2) the nature of the copyrighted work;

(3) the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and

(4) the effect of the use upon the potential market for or value of the copyrighted work.

The fact that a work is unpublished shall not itself bar a finding of fair use if such finding is made upon consideration of all the above
factors.

B. Works In The Public Domain

Attorney Stephen Fishman in his book entitled The Copyright Handbook: How To Protect & Use Written Works (7th Ed.) defines works in
the public domain as follows:

Any work that is not protected by copyright is said to be in the public domain. This includes works in which 1) the copyright was lost, 2)
works in which the copyright expired and 3) works authored or owned by the federal government. 3) [It also includes works that their
authors have “donated” to the public domain.]

According to Fishman, the “Public domain means what it says – such works belong to the public as a whole. Anyone is free to use them
any way he/she wishes without asking anyone’s permission. And no one can ever obtain copyright protection for public domain material,
no matter how he/she transforms it. Everything published in the United States before 1923 is now in the public domain, freely available to
us all.” 4

For example, if you choreograph a piece to a song which: 1) the copyright was lost, 2) the copyright expired, 3) the work was authored or
owned by the federal government, 4) the author “donated” it the public domain or 5) it was published before 1923 then, you can video tape it
and sell the copies without concern that you are infringing on the copyright ownership of that song. The reason is, it belongs to the pubic
and everyone is free to enjoy it without need of seeking permission or paying a licensing fee.

NOTE: If you are unclear on this concept, I encourage you to read some of the resources listed below. It may also be extremely beneficial
for you to seek out and obtain competent counsel from an attorney or other professional with knowledge of Intellectual Property Law.

C. The Worship Service Exemption

Copyright law provides one specific “religious” worship service exception, where permission is not required. That exception is the
performance of copyrighted music within a worship service.

§ 110. Limitations on exclusive rights: Exemption of certain performances and displays

Notwithstanding the provisions of section 106, the following are not infringements of copyright:

(3) Performance of a nondramatic literary or musical work or of a dramatico-musical work of a religious nature, or display of a work, in the
course of services at a place of worship or other religious assembly;

For example, when the dance ministry or a dancer ministers and plays a song on a copyrighted CD or tape during a worship service (which
is to be distinguished from all other activities the church engages in), pursuant to section 110(3) of the US Copyright Law, then the
performance of that dance to the copyrighted song is specifically exempted. It does not require permission. If the choir sings a copyrighted
song and the dancers dance while the choir sings as part of a worship service, that performance is specifically exempted.

Everyday Scenarios

Several everyday scenarios regarding the use of copyright protected works is listed below.

DISCLAIMER – VERY IMPORTANT – DISCLAIMER

I know one of the main questions burning in the hearts of many people reading these articles is “Can we videotape our dance ministry
services and sell the videos?” Now, I am going to do what any attorney worth their weight in gold would do in this situation. I am going to
issue a blanket disclaimer. All information contained in this article, specifically all the information contained in the next few everyday
scenarios, is for general informational purposes only. It is not and should not be used as a substitute for legal counsel or legal advice.  In
the words of William Patry: “If you require legal or other expert advice, you should seek the services of a competent attorney or other
professional.”

A. Making a Special CD Mix- I have three worship CDs I bought. I really like three songs on each disc. I want to make a special worship
mix with those nine songs – just for my personal listening enjoyment.

Q: Can I do that?

A: The general answer to this question is
YES. You can act as your own DJ and make a special CD for your personal listening pleasure.

B. Sunday Morning Worship Service- As part of the Sunday morning worship service, the dancers dance as the CD song version of "No
Weapon” is played. The dance is done live in a place of worship and seen by the people in the congregation at that time.

Q: Does this fall into the Religious Services Exception to Copyright Law?

A:
YES. This use falls into the Religious Services Exception of the copyright law. When you use copyrighted music as part of a live
  worship service (regardless of location -- recognizing that many churches fellowship in schools and other buildings, etc.) they look
 at the purpose of the service. The key is if it is part of a worship service. This service is to be distinguished from all of the other
 activities the church group does.

C. Sunday Morning Worship Service -- Videotaped and Sold- The entire Sunday morning worship service is taped and the dance is
included on the videotape that will be sold.

Q: Can the church sale the video of the service that includes the dance without obtaining permission?

A: The specific answer that I give is this: If your church has legal counsel, then
this is a matter they should research. They may consult
  with others who have expertise in this area and provide the ministry with appropriate legal counsel for your specific situation.

The general answer that I give based on my personal reading and understanding of the laws as presented at the time of the writing of this
article is:
This is a recording issue. Could it possibly fall into the Fair Use category or any other copyright exemption? Anything is possible.
Yet, generally, when making a recording for tape, video, etc., the law requires that permission be obtained. Generally, to obtain permission,
one would contact the publishers. Generally, depending on the specifics of the situation, permission may be granted free of charge or it
may require a license agreement and have a fee associated with the use. One can seek out competent legal counsel and one can also
contact the Harry Fox Agency (
www.harryfox.com) regarding a more detailed response to this question.

D. Same Service -- Shown on Television as Part of Pre-Taped Church Broadcast- The same service from Example B is sent to the local
TV station (network and/or cable) and it is played on TV.

Q: Is this use covered through a blanket licensing agreement that the TV station may have for using music on their stations?

A: The specific answer that I give is this: If your church has legal counsel, then
this is a matter they can research. They can consult with
  others who have expertise in this area and provide the ministry with appropriate legal counsel for your specific situation.

The general answer that I give based on my personal reading and understanding of the laws as presented at the time of the writing of this
article is: The TV stations should have a license to cover this area. To be absolutely sure, one can seek out competent legal counsel and
one can contact the station to see if it is properly licensed. Generally, if you have received permission to include the dance on the videotape
that will be sent to the television station, you have done the part that is required of you.

E. Same Service -- Shown on Church’s Internet Site- The same service from Examples B & C is played on the Internet on the Church’s
Web Site.

Q: Is this permissible?

A: The specific answer that I give is this: If your church has legal counsel, then
this is a matter they can research. They can consult with
  others who may have expertise in this area and provide the ministry with appropriate legal counsel for your specific situation.

The general answer that I give based on my personal reading and understanding of the laws as presented at the time of the writing of this
article is: this is an area of the law (the application of existing Intellectual Property Laws to the ever evolving internet) that is constantly
changing. Generally, both BMI and ASCAP have Internet licenses that may be granted to the church to cover the music that will be played
over the churches web site. Generally, if it is a onetime event, one may only have to request permission and a license may not be required.
As with the other scenarios, these are decided on a case-by-case basis according to the situation and facts presented. One can seek out
competent legal counsel and log unto the web sites for BMI (
www.bmi.com) and ASCAP (www.ascap.com) for more information on
obtaining an Internet license.

F. Church Choir Sings  “No Weapon”, Dancers Dance and Service is Video-Taped

Q: Are they required to obtain permission when their church choir sings and they dance and that combination is taped for sale, TV or
  Internet?

A: Generally speaking, the live performance during a worship service, falls within the section 110(3) of the US Copyright Law exemption
  and does not require permission. Generally, any time a video or other recording is made, permission should be sought and obtained.
  One can seek out competent and knowledgeable counsel from an attorney or other appropriate professional regarding the specifics
  on your situation.

G. Church Dance Service- All the dances are to recorded music by an assortment of different artist. It is a church group but the function is
not held in a church because the church is too small, so it is held in a school or other large auditorium. It is a Dance Worship Service.
Tickets are not sold, but an offering is taken up. The dancers do not receive any money for dancing. A video is made [as a historical record
for the ministries archives] and sold to anyone who wants to buy it. The proceeds [if there are any] will go back into the dance ministry or to
the church.

Q: What must be done in this situation?

A: The specific answer that I give is this: If you are part of a church ministry that has legal counsel, then
this is a matter they can
  research. They can consult with others who may have expertise in this area and provide the ministry with appropriate legal counsel
  for your situation. If you are not a part of a church, then you may also contact legal counsel. Most states have Attorney Bar Associations
  that have Intellectual Property Law divisions. There are also National Bar Associations. You can contact them to find the names of
  attorneys specializing in the area of law that you need and to obtain any materials that they may have published on this issue.

The general answer that I give based on my personal reading and understanding of the laws as presented at the time of the writing of this
article is:
Obtain permission. Could it possibly fall into the Fair Use category or any other copyright exemption? Anything is possible. Yet,
generally, to do this, one would contact all of the appropriate copyright owners, performance rights organizations and publishers. It is
possible that this will probably not require a license. But every situation is different. Therefore, seek out competent and knowledgeable
counsel from an attorney or other appropriate professional.

Informed and Free

The main goal of this series of articles is to open our eyes to the laws of GOD and the laws of the land that impact us as liturgical dancers
and all who are God’s stewards in our various areas of ministry. Now that you have read the information, prayerfully consider it. If the Holy
Spirit pricks your heart – then you know there is an area that He wants to deal with you in. If He convicts you, He does not condemn you. He
will help you, forgive you, heal you and direct your path.

“Trust in the Lord with all of your heart and do not lean to your own understanding. In all of your ways [including the application of
applicable laws] acknowledge Him and He shall direct your paths.”
(Proverbs 3:5-6)

There are several paths that He will take you on. Some will be gradual and others will be longer. But you will learn all He intends and He
will bring you to the expected place.

Remember, He who the Son makes free is free indeed. I declare that you are not bound because of the knowledge obtained. Rather, you
will be freer to go forth in the things and assignments that God places in your hands.

TIP OF THE MONTH

Tip #1The Earth is the LORD’S and the Fullness Thereof

* God granted the musicians, singers, producers, authors, writers and other people the abilities to create. He understands there are laws
of the land we have to abide by. If we ask, He will give us wisdom and godly counsel.

* The counsel and wisdom of the LORD will help us to serve as good stewards. Seeking out counsel from a multitude of counselors
[ministerial, legal and other professionals] will keep us safe (Proverbs 11:14). The LORD can grant us favor with man. He will give us
ideas on how we can make sure we abide by the existing laws [while remaining free from bondage].

Tip #2Always Remember: God’s Grace is Sufficient

* God is merciful. He forgives us when we seek forgiveness and repent. God is full of lovingkindness and tender mercies. He knows the
intents of our hearts. His grace is sufficient to help us and to sustain us.

* May the Holy Spirit of the Living God breathe upon all who were sharpened by the last two installments. May the Holy Spirit raise you up so
that you will walk according to the principles of God’s Word and abide by the laws of the land.

* He who the Son makes free is free indeed. The Holy Spirit will continue to liberate you from any bondage that may have taken place in the
past. "

Another holiday celebration has passed and some of us may
feel exhausted. In preparing Palm Sunday and Resurrection
presentations, I kept telling myself, "RELAX, GOD IS IN
CONTROL!"

As we grow each year in ministry- be it, singing, dancing,
preaching, teaching etc., we will discover our gifts and grow in
our service to the Lord and His people. I thought about these
5 areas in particular, especially when more is required of us:
1. Your service will bring you joy. I have told you this so that my joy may be in you and that your joy may be
complete. Joh 15:11 –(NIV)

Managing Your Ministry

Managing goes a long way. Sometimes you will feel you have to be all things to all people. We will continue each day to
build in order to keep the anointing flowing! Just when you think that you have reached your goal, another event or
challenge will present itself. It’s not over until God says it’s over. Stay on your post!

THE KEEPING POWER IS IN PRAYER, PASSION, AND BEING PERSUADED TO KEEP THE FAITH!

Don’t forget- He will take care of our business, when we take care of His!

And The Walls Came Tumbling Down...

The process of going out and ministering in dance is very simple as long as guidelines are applied, some of
which are as follows:

1-The Lord has assigned your group to do dance outreach.

2-Your group must have permission from your church leadership to go out and minister in dance.

3-Even if your Christian dance group is not affiliated with a church, you must have a Pastor or leader from your
church that your group is accountable to.  It is important to have a Pastor to guide and to feed your group with
the Word in a regular basis.

4-Your group must have choreography that is appropriate to minister publicly (dance conferences, other
church services, nursing homes, jail facilities, weddings, schools, hospitals, streets, etc).

5- You need to confirm any invitations you receive and ask any questions that may pertain to the
accommodation of your group. Find out what time your group should be at the event. Don't be afraid to ask if
you can arrange a practice or blocking beforehand. Verify if you will have a place to change garments and to
pray etc. Do not assume the host of the event knows it all. It is your responsibility to be prepared.

6-Your group must be prepared for the challenges the enemy will try to bring and the victories the Lord will
obtain on your behalf. All the glory belongs to God! Be united and on one accord.

Here are a few challenges I have experienced:

a- Not enough practice time due to last minute invitations (Thank God the Holy Spirit danced through us...).

b- No rehearsal in the actual space to minister and finding out that space is too small for the whole group to
dance (God is always in control and He managed the stage).

c- Last-minute sick calls of dancers (Again, God worked it out!)

d- Car trouble (even the new ones…). Prayer works every time!

e- Trouble with props, garments and accessories during transportation (God’s divine intervention through His
workers hands fixed the problem).

The solution for the above challenges is to PRAY before, during and after each time you minister. You must
choose a prayer team to cover the group in prayer always.

No matter what, if it is God’s will for your group to minister, God will go with you and you will see Him being
glorified, people being saved, joy being spread, and the Word being danced through you.

Just remember what Jesus said,  “…not My will but yours be done.” Luke 22:42.

There is a pressing need in the Body of Christ to distinguish and discern the difference between the Lord of the Work and the work of the
Lord. How easy it is to confuse these two things and treat them as one and the same. Yet the difference before God is quite vast.

This difference was revealed to me several years ago. I was conducting some meetings in Texas and attended a ministerial luncheon
consisting of local pastors. My presence as a visitor was acknowledged and I was invited to stand and "share a few words." What would I
say to these pastors?

The Lord had already prepared my heart with a special word just for them. I said, "Brothers, I came all the way from North Carolina to
remind you of one thing: the work of the Lord is NOT the most important thing."

I allowed my words to sink into their hearing for a moment and the silence was deafening. I understand now what Jesus experienced
when the Bible says that "He knew within Himself" that the people questioned and doubted in their hearts. I could sense this as these
pastors silently wondered what could possibly be more important than the work of the Lord.

"Brothers, the Lord of the Work is more important than the work of the Lord," I said. And I sat down.

In my experience, fewer than one person out of one thousand really understands this, even when they nod and say amen. I am still growing
in this revelation. I am constantly being reminded by the Lord, "Chip, I am more important than your ministry. I am your priority. This is My
work, not yours. I reserve the right to separate you for service or place you on the shelf. I reserve the right to send you forth or keep you at
home. The Lord of the Work is more important than the work of the Lord. You keep saying this, but you do not always practice it."

According to the Scriptures, the Kingdom of God exists wherever Christ has the preeminence. To seek first the Kingdom of God is to seek
the preeminence of Jesus over all things. For many years I assumed that seeking first the Kingdom of God meant to seek first the work of
the Lord - putting the ministry before everything else, even before the needs of my family.

While my intentions were good, the Scripture does not say, "Seek first the ministry." It says to seek first the Kingdom of God. How does this
apply to ministry? It means simply this: I must be governed by the Lord of the Work, not the work of the Lord.

The "work of the Lord" tends to take on a life of its own if we are not careful. We begin in the Spirit but then we use fleshly means to
perpetuate the ministry. I can say this because I have been guilty of it. The thought and the intention may be good, but before we realize it,
the work of the Lord becomes preeminent over the Lord of the Work. In fact, the minister, the pastor, the teacher, the apostle, or the prophet
assumes the position of the Lord of the Work. How quickly the flesh comes in!

If God's Eternal Purpose is for Jesus to have the preeminence over all things then this certainly includes the work. The Lord of the Work
does not change, but the work of the Lord is constantly changing. The Lord of the Work governs the time, the place, the people, the
provision, and the assignment. All these things may change as the Lord of the Work sees fit. He sets one up and brings another down. He
opens doors and closes them. He leads us to speak or bids us to remain silent.

In the Book of Acts no one initiates anything. They are wholly governed by the Holy Spirit. He sets people apart, He sends them forth, He
tells them where to go - forbidding them from going to certain places, only to send them later, when the time is right. We do not find
apostles or prophets or pastors "working their gift" and going about willy-nilly, just doing whatever they feel like doing.

Watchman Nee observed that God often puts His greatest ambassadors in chains. Brother Nee himself spent the last twenty years of his
life in the seclusion of a Communist prison. Is this not a waste? It sometimes appears that the Lord of the Work is not doing things
correctly. We want to go out and the Lord tells us to stay home. We want to stay home and the Lord tells us to go. He is the Lord of the
Work. I cannot explain everything He does, nor can I understand. In humility we must bow down and say, "You are the Lord of the Work, and
I am only a worker. You are the Master, and I am the servant. You know what You want and what You need far more than I do. I only see a
portion, but you see all things. So I submit myself and my work to you!"

Brothers and sisters, this is the only safe way. Can we submit ourselves to the Lord of the Work? Can we offer Him our gifts, our talents,
and our abilities on the altar and let Him direct things? I believe that almost every apostle, prophet, or pastor that has gotten off track has
done so because of this very thing - making the work of the Lord preeminent over the Lord of the Work. God gives them a gift, or a calling, or
a ministry, and they begin working at it until they no longer need to be governed by the Holy Spirit. They have to constantly put out and
perform. Really, they are too gifted. We need a little less giftedness and a lot more brokenness.

When I go back and take inventory of the places I have traveled and ministered in over the last few years I find a pattern. They were doing
just fine until I arrived and proclaimed to them the preeminence of Jesus Christ and His sovereignty as the Lord of the Work. This word
created a crisis in their fellowship although most of them did not realize it at the time. Sometimes it takes years for that crisis to fully
develop, but nearly every church or group I have visited has since fallen by the wayside, voluntarily closed their doors, or gone into a deep,
dark deception. As you can imagine, I do not get invited much anymore, and I am less and less inclined to go.

This is a painful thing - realizing that you have labored in the flesh, labored for religion, built a house of straw on some foundation other
than Christ. But if we are so good at our ministry that we don't need to hear from God and be governed by His Spirit on a daily basis then
we are far gone. We have left our first love and made the work of the Lord more important than the Lord of the Work. We need to repent.

I need a ministry that is so impossible to perform that apart from the miraculous, divine intervention of God it will be absolutely nothing!
God delights in the impossible because we are forced to rely upon Him - anything less and we begin to imagine we can do it. I need a gift
from God that requires me to be on my face before Him in order for it to operate. If I can get up in the morning and just "work it" without Him
and apart from Him then it is a dead thing. There is no life apart from abiding, and outside of that abiding I cannot draw upon the Life.

This is the only way the Lord will use something: if He can have the preeminence. He must retain the first and the final place. He must be
the Head. The Lord of the Work is more important than the work of the Lord. I pray we will grasp this truth and make the necessary
adjustments before it is too late and we suffer loss. May this word convict our hearts. Amen.
